Covid emergency: Delhi HC permits serving summons on Whatsapp

In the wake of the rising cases of COVID-19 in the national capital, the Delhi High Court on Friday has permitted service of notice/summons/daks through email, fax or Whatsapp.

Delhi has record high cases with health infrastructure running in full occupancy. India surpassed 2 lakh daily cases becoming the worst hit in the second wave of corona virus.

The physical mode of service has been withheld for now as per the circular issued by the High Court, except where there is a specific order to this effect by the Court.

The circular states that “till further orders, all documents/notices/daks through physical mode be dispensed with, except there is a specific order to that effect by the honourable court, and that such service be instead permitted to be effected through Email/fax/Whatsapp.”

“The process of sending the documents/summons/Oaks in electronic mode will continue to be done by the Despatch Branch/ Process Serving Agency, in co-ordination with respective judicial branches and IT Branch, from their seats only”.

The conventional mode of physical delivery may be restored once the normalcy returns. courts across India are switching to the virtual mode of operation due to the risk of physical hearings.
