Delimitation: Plea in Delhi HC alleges splitting of Dalit, minorities into many wards

The Delhi High Court on Friday sought the response of the Union government and the Delhi government on a public interest litigation (PIL) petition by a Congress leader challenging the delimitation process followed for the upcoming Municipal Corporation of Delhi (MCD) elections.

The PIL filed by the President of Delhi Pradesh Congress Committee, Anil Kumar claimed the formula adopted by the Union government for delimitation was arbitrary as there was a huge disparity in the population of wards, Bar and Bench reported.

“The Respondents in the final draft order have not followed the very purpose of the delimitation exercise to alter the boundaries of respective wards as per the latest Census figures so as to reflect as equal and proportionate representation,” read the plea.

The Congress leader also argued that the division of wards was done based on community and religious lines, thereby, violating of the basic tenets of the Constitution, the legal website reported.

“The splitting of Dalit and Minority population from one ward to many adjoining wards has been done under conspiracy to bulldoze their voice,” the plea alleged.

The delimitation process has pushed disadvantaged wards falling in the lower income group further into the dark by increasing their population sizes, whereas elite wards have been handpicked for smaller population sizes, the plea alleged.

The notices to Union government and Delhi government were issued by the bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad.

Anil Kumar sought a fresh delimitation of the wards as per the formula prescribed and quash the notification of the earlier wards as unconstitutional.
