Delhi pogrom: Supreme Court refuses to stay proceedings against Tahir Hussain

The Supreme Court Monday dismissed a plea challenging the Delhi High Court order which refused to stay criminal proceedings against former AAP councillor Tahir Hussain in the 2020 northeast Delhi violence case.

“No reason to interfere at this stage when the matter is subjudice before the High Court,” said the bench of Justices Ajay Rastogi and CT Ravikumar.

This comes two months after the High Court had refused to stay criminal proceedings against Hussain in connection with the three FIRs registered against him in connection with Delhi pogrom.

Hussain and more than a dozen Muslim activists and rights defenders have been languishing in jail under draconian UAPA since 2020 in connection with the Delhi pogrom cases. Human rights bodies across globe including UN Rights and Opposition parties in India condemned the arrests and demanded a fair probe into the violence.

On Monday, Senior Advocate Menaka Guruswamy, appearing for the petitioner, asked if the High Court may decide the matter “more expeditiously”, bench responded, “No, thank you”.

There are a dozen cases against Hussain, a prominent local politician in the northeast region.
