No interim bail for PFI founding chairman E Abubacker, provide best treatment at AIIMS: Delhi court

Delhi’s Patiala House Court Monday has directed the Tihar jail authorities to shift prominent Muslim leader and founder chairman of now-banned outfit Popular Front of India E Abubacker to All India Institute Of Medical Sciences in Delhi, his son informed Maktoob.

The 70-year-old Muslim leader is currently in Delhi’s Tihar jail for a case investigated by the National Investigation Agency under provisions of India’s terror law, Unlawful Activities (Prevention) Act and the National Investigation Agency Act.

“…it is directed to the jail authorities that applicant/accused be taken to AIIMS hospital with his all medical documents and investigation scan reports carried out uptill now so that applicant/accused may be provided appropriate treatment, diet plans for all his medical difficulties at AIIMS hospital,” said Shailender Malik, NIA special judge.

“In this regard copy of order be sent to Director AIIMS with the request for providing timely and best of the treatment to the applicant/accused, so that there should not be any apprehension left in the minds of any one for applicant/accused regarding laxity in the medical treatment. Having so decided, taking note of above entire facts at this stage, no case is made out for interim bail,” Malik said in the order.

In his petition, former PFI leader said that he is suffering from serious medical ailments, including a rare form of cancer – gastroesophageal junction adenocarcinoma – and Parkinson’s disease.

“Cancer, Parkinson, diabetes, memory loss…,” Amal Thahseen, Abubacker’s son said to Maktoob while tries to name chronic illnesses of his father who has been booked and arrested in a case first time in his three decades of political leadership.

Earlier the Delhi High Court m refused to hear the bail plea filed by Abubacker, saying that Justice Anoop Kumar Mendiratta does not have the jurisdiction to pass an order on the petition since Abubacker has been booked under the National Investigation Agency Act. Section 21 of the Act states that all appeals be heard by a two-judge High Court bench. The High Court allowed Abubacker’s counsel to first seek bail before the trial court and then appeal before a division bench of the High Court.

Abubacker has been in judicial custody since October 6. Hundreds of Muslim activists associated with PFI including top functionaries of the outfit were arrested under draconian UAPA and have been languishing in jail across India.

On 28 September, India banned PFI and its associates including Campus Front of India, Rehab India Foundation, All India Imams Council, National Confederation of Human Rights Organisations, National Women’s Front, Junior Front, Empower India Foundation and Rehab Foundation, Kerala. 

Abubacker has been either the founding chairman or patron for all of these outfits. The organisations are declared “unlawful associations” for a period of five years.

While speaking to Maktoob, Abubacker’s family refutes terror funding claims against his father and maintains that he was committed to developing the backward classes of Indian society.

The Popular Front of India has been accused by Union government of being involved in terror funding, organising training camps and radicalising persons to join proscribed organisations while Human rights activists and Muslim groups called the ban “arbitrary.”
