Madras High Court quashes FIR against CAA protesters, says protests happened all over India

The Madras High Court quashed the first information report filed against advocates T. Lajapathi Roy and Henri Tiphagne, two Citizenship Amendment Act (CAA) and National Register Citizenship (NRC) protesters, and took cognisance that no untoward incident had taken place and observed that there were protests across the country against amendments to the Act.

According to a Live Law report, the court said in the order: “The Country had witnessed protests all over by different sections of people against the said amendments. Since the protest was peaceful and even the First Information Report does not disclose any act of violence or happening of the untoward incident, I am of the view that the continued prosecution is not warranted. Quashing the same will secure the ends of justice.”

Taking into account that no act of violence was committed, the judge allowed the petition and quashed the FIR registered against the advocates.

The court also said the benefit of the order would enure in favour of the other accused in the case as well, who had not filed petitions seeking to quash FIRs.

FIRs had been registered against as many as 26 protesters in the wake of an anti-CAA protest near Goripalayam Pallivasal, on February 8.
