“Wait for two days”: SC to list appeals against Karnataka HC’s hijab judgment

“I will list. Wait for two days”, CJI Ramana told Senior Advocate Meenakshi Arora.

A batch of petitions have been filed in the top court against the Karnataka High Court order, which held last month that the headscarf was not essential to Islam.

The petitioners sought urgent listing of the petition by stating that though it was registered on 30.03.2022, despite passage of one month, it has not been listed for hearing, in the normal course, Live Law reported.

Shadan Farasat, another lawyer appearing for the petitioners, argued that an urgent hearing of the matter was needed as hijab-wearing students were being barred from appearing in the Pre-University Certificate examinations.

 On March 16, the Supreme Court had said that it would take up the matter after the Holi vacations.

Muslim students in Karnataka have been protesting the ban on hijab in educational institutions, saying the Islamophobic move of the Karnataka government violates their religious freedom guaranteed under India’s constitution.

Muslim students, activists, and Opposition leaders across the country allege that these attacks on Muslim symbols and practices are part of the larger Hindutva agenda of imposing majoritarian values on the country’s 200 million Muslims.

Soon after the verdict, Muslim students in Karnataka who have been fighting against the hijab ban, Muslim leaders, human rights defenders, and Opposition parties had said the verdict is enabling discrimination against Muslim students and it suspends the fundamental rights of hijab-wearing students.
