“Will you commit murder if senior directs so?” the Madras high court asked on Wednesday while dismissing as withdrawn a plea moved by superintendent of police D Kannan seeking to discharge him from a case filed by a woman IPS officer alleging sexual harassment charges against special DGP Rajesh Das.
Kannan was added as a co-accused in the case based on the complaint filed by the woman IPS officer that he had stopped her car to prevent her from proceeding to file a complaint against the DGP.
When the petition came up today, Kannan’s lawyer told the judge that his client had carried out the instructions given by his superior, PTI news agency reported. Disobeying the orders of the superior officers would amount to insubordination, he contended.
It was then Justice Velmurugan asked whether Kannan would commit murder if he was told to do so. Only lawful instructions can be carried out.
God alone can save the police department, Justice P Velmurugan exclaimed.
“It is a shame that the women in police department are not treated with the dignity they deserve,” he observed.
If a senior officer faces such allegations, how will the people have faith in the department. Only 10 per cent of the police officers are acting as per their conscience, the judge said, adding such incidents are a shame on the department.
Since the court was not inclined to entertain the plea, the petitioner sought to withdraw his petition.
