Hindu worshippers’ plea on right to pray in Gyanvapi mosque maintainable: Allahabad HC

In a significant development in the Gyanvapi mosque case, the Allahabad High Court on Wednesday dismissed a plea by the Anjuman Intezamia Masjid Committee against the civil suits by Hindu parties that sought the right to worship within the mosque premises, LiveLaw reported.

The Court upheld the 12 September 2022 order of the Varanasi Court which held the suit to be maintainable.

In 2021, five women filed a suit in the Varanasi District court seeking the enforcement of their right to worship Maa Shringar Gauri and other deities within the Gyanvapi mosque complex.

The Masjid Committee, in October 2022, challenged the court order in the Allahabad High Court.

In its order passed in October 2022, Varanasi District Judge Ajay Krishna Vishwesha observed that the suit of the plaintiffs is not barred by the Places of Worship (Special Provisions) Act, 1991, The Waqf Act 1995, and the U.P. Shri Kashi Vishwanath Temple Act, 1983, as claimed by the Masjid Committee in the Supreme Court, in 2021.
