Lok Sabha disqualifies Lakshadweep MP Faizal for second time this year

Lakshadweep’s only Member of Parliament Mohammed Faizal PP was disqualified from the Lok Sabha on Wednesday, a day after the Kerala High Court rejected his plea to suspend his conviction in a murder attempt case.

This is the second time the NCP leader has been disqualified within a year.

“In view of order dated 03.10.2023 of the Hon’ble High Court of Kerala, Shri Mohammed Faizal P.P., Member of Lok Sabha representing the Lakshadweep Parliamentary Constituency of the Union Territory of Lakshadweep, stands disqualified from the membership of Lok Sabha from the date of his conviction, i.e. 11th January, 2023,” Secretariat bulletin stated.

He was earlier disqualified in January after the Kavaratti sessions court convicted him and three others on the charges of attempting to murder P. Salih. Section 8(3) of the RPA mandates that an MP can be disqualified if convicted and sentenced to not less than two years of imprisonment.

In March, his membership in Lok Sabha was restored after he approached the Supreme Court of India for the same, stating that the Kerala High Court suspended his conviction.

However, the suspension of the sentence of Faizal and three others, as per an earlier High Court order, would continue pending the final disposal of their appeal.

In an interview with Maktoob in March, Faizal refuted the charges against him and accused the administrator of conspiring against him.

On January 11, 2023, a Kavaratti sessions court sentenced Faizal and three others to 10 years in jail and imposed a fine of Rs 1 lakh on each of them in the murder attempt case.
