Jahangirpuri violence: HC orders police to produce Muslim minor boy before juvenile justice board

The Delhi High Court on Monday ordered to produce a production before a juvenile justice board of a Muslim minor boy who was arrested in connection with the Jahangirpuri violence a few days ago during a Hindu rally.

The Court gave the order in a Habeas Corpus filed by the sister-in-law of the arrested person.

Mohd. Aslam who was arrested FIR No.440/2022 was sent to one-day police custody remand by a Duty Magistrate of Rohini Courts on Sunday.

Petitioner was illegally detained by the Delhi Police in contravention to the procedure laid down in Juvenile Justice Act 2015.

Clashes broke out last week in Jahangirpuri area during a Hanuman Jayanti procession after Hindu youth “provoked” Muslims by shouting derogatory slogans in front of a mosque and threatening to hoist the saffron flag on the minaret.

“The minor Mohd. Aslam has also been subjected to beating and violence by the police and therefore, it is humbly submitted that this Hon’ble Court may also direct the medical examination of the minor and inquiry into the circumstances leading to the unlawful detention of a minor for 2 days,” read the petition.

The plea has been moved by Advocates Tara Narula, Tamanna Pankaj, Priya Vats and Deeksha Dwivedi with assistance of Association for Protection of Civil Rights (APCR).

Maktoob got access to the Aadhar card of the minor and the FIR. The Medio-legal certificate by police says the minor has also sustained injuries.

The FIR has been registered under sec. 147, 148, 149, 186, 353, 332, 323, 427, 436, 307 ,120B of the Indian Penal Code and sec. 27 of the Arms Act.

The Police had said that they have to go through the CCTV footage and identify other persons involved in the matter.

The petition also demanded an “inquiry into the circumstances leading to the unlawful detention and treatment of Mohd. Aslam by the respondent investigating agency”.

So far 17 people were arrested in connection with the violence and 14 of them are Muslims.
