BSP MP Afzal Ansari loses Lok Sabha membership following conviction in Gangster Act case

Bahujan Samaj Party MP Afzal Ansari was Monday disqualified as a Member of Lok Sabha from the date of his conviction in a Gangster Act case.

Ansari is an MP from Uttar Pradesh’s Ghazipur district.

Two days after the conviction and sentencing of Ansari to 4 years in prison under the Gangster Act Case by a special MLA/MP Court in UP’s Ghazipur district, a notification in this regard was issued by the Lok Sabha Secretariat today. This disqualification was implemented through the provisions outlined in Article 102 (1) (e) read with Section 8 (3) of the Representation of People Act 1951.

It is noteworthy that this disqualification can be overturned if a higher court grants a stay on the conviction of the individual in question or decides the appeal filed against the conviction in their favour.

Earlier, the court had passed a verdict and imposed a sentence of 10 years’ imprisonment on Mukhtar Ansari who is currently serving his sentence in Banda district jail. The case was filed under the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act in 2007 at the same Mohammadabad police station in Ghazipur district. Mukhtar is the younger brother of Afzal Ansari.
