Tahir Hussain gets bail in sixth case related to Delhi violence, to remain in jail under UAPA case

A Delhi Court on Saturday has granted bail to former Aam Aadmi Party Councillor Tahir Hussain in a northeast Delhi violence case registered at Dayalpur police station.

Hussain was granted bail in five separate cases related to the northeast Delhi violence two months ago. However, he will remain in judicial custody in other FIRs registered against him, including the UAPA case. A total of 11 FIRs were registered against Tahir Hussain in connection with the violence.

Additional Sessions Judge Pulastya Pramachala while granting bail to Hussain, noted that the two FIRs in which the High Court granted bail, and the case at hand, took place at proximate time and places. The judge also noted that many witnesses are common in all FIRs.

“In that situation, even though a bail order may not be a precedent for other case, in the peculiar situation, bail granted to the applicant by a court higher in hierarchy to this court, does create a material change in the circumstances in favour of the applicant,” the court said.

“This material change in the circumstance in itself becomes a ground to grant bail to the accused/applicant in this case as well. Hence, application is allowed,” it added.

Advocate Tara Narula has appeared for Hussain, said Nadeem Khan of Association for the Protection of Civil Rights (APCR), a civil rights advocacy group.

Three months ago, Hussain moved the trial court seeking regular bail in the UAPA case.

Many international and national rights groups and rights activists have been demanding the release of Hussain and other Muslim activists who were arrested under draconian UAPA in connection with the Delhi violence.
